2. Service Description

SilqueCRM provides salon and beauty business management software, including client management, appointment scheduling, AI-powered style recommendations, and communication tools.

3. AI-Powered Features & Liability

3.1 AI Technology: Our AI-powered features, including style recommendations, color analysis, and hair system suggestions, are provided for informational and creative purposes only. These features use machine learning algorithms that may not always produce accurate or suitable results.

3.2 Professional Judgment Required: AI recommendations should always be reviewed and validated by licensed beauty professionals. Users must exercise their professional judgment and expertise before implementing any AI-generated suggestions on clients.

3.3 No Medical Advice: AI features do not constitute medical, dermatological, or health advice. Any recommendations regarding scalp conditions, allergies, or chemical treatments should be reviewed by qualified medical professionals.

3.4 Limitation of Liability: SilqueCRM and its AI providers disclaim all liability for results, damages, or adverse reactions resulting from the use of AI-generated recommendations. Users assume full responsibility for all professional services provided to their clients.

4. AI Analysis Limitations & Disclaimers

4.1 Accuracy Limitations: AI analysis of hair texture, skin tone, face shape, and other physical characteristics may be inaccurate due to lighting conditions, image quality, camera settings, makeup, or other factors. Results should not be considered definitive assessments.

4.2 Training Data Bias: AI models are trained on datasets that may not represent all ethnicities, hair types, skin conditions, or beauty standards. Recommendations may exhibit bias or may not be culturally appropriate for all clients.

4.3 Chemical Compatibility: AI cannot assess individual allergic reactions, chemical sensitivities, or contraindications. Users must perform proper allergy testing and chemical compatibility assessments independently of any AI recommendations.

4.4 Hair and Scalp Health: AI cannot diagnose hair loss conditions, scalp disorders, or underlying health issues. Any concerns about hair or scalp health should be referred to appropriate medical professionals.

4.5 Experimental Features: Some AI features may be in beta or experimental phases. These features carry additional risks and should be used with extreme caution or avoided for client services until fully validated.

5. Third-Party AI Services & Data Processing

5.1 Third-Party Providers: Our AI features utilize third-party artificial intelligence services. We do not control these external services and disclaim liability for their performance, availability, or results.

5.2 Image Processing: Client images uploaded for AI analysis may be processed by external AI services located outside your jurisdiction. You warrant that you have obtained explicit written consent from clients for such processing.

5.3 Data Retention: Images and analysis results may be temporarily retained by AI providers for processing purposes. We cannot guarantee immediate deletion from third-party systems.

5.4 Service Interruptions: AI services may be unavailable due to maintenance, technical issues, or provider limitations. We do not guarantee continuous availability of AI features.

6. Professional Override & Safety Requirements

6.1 Mandatory Professional Review: All AI-generated recommendations must be reviewed and approved by a licensed beauty professional before implementation. No AI recommendation should be followed without professional oversight.

6.2 Safety First Policy: If an AI recommendation conflicts with professional judgment, safety protocols, or client health considerations, the professional's judgment must take precedence over AI suggestions.

6.3 Documentation Requirements: Users should document their professional decision-making process when accepting or rejecting AI recommendations, including reasons for any modifications made.

6.4 Client Communication: Clients should be informed when AI analysis is being used and that final decisions rest with their beauty professional, not automated systems.

7. Informed Consent & Client Rights

7.1 AI Disclosure: Clients must be informed when their images or data will be analyzed using artificial intelligence, including the limitations and potential inaccuracies of such analysis.

7.2 Opt-Out Rights: Clients have the right to refuse AI analysis and request traditional consultation methods only. No services should be denied based on AI opt-out preferences.

7.3 Data Minimization: Only necessary client data should be submitted for AI analysis. Users should avoid uploading excessive personal information not directly relevant to the beauty service being provided.

7.4 Vulnerable Populations: Extra care should be taken when using AI analysis for minors, elderly clients, or clients with cognitive impairments. Enhanced consent procedures may be required.

8. Liability Caps & Insurance Requirements

8.1 Damage Caps: In no event shall SilqueCRM's total liability exceed the amount paid by the user for the service in the twelve months preceding the claim, regardless of the theory of liability.

8.2 Professional Insurance: Users are strongly advised to maintain appropriate professional liability insurance that covers the use of artificial intelligence tools in their beauty practice.

8.3 Immediate Notification: Users must immediately notify SilqueCRM of any adverse reactions, injuries, or damages allegedly related to AI recommendations so we can improve our systems and prevent future incidents.

8.4 Statute of Limitations: Claims related to AI features must be brought within one year of the incident or they are forever barred, regardless of applicable law.

9. Data Protection & Privacy

9.1 Client Data: You are responsible for obtaining proper consent from your clients before uploading their personal information, photos, or other data to our platform.

9.2 Image Processing: Client photos may be processed by third-party AI services. You warrant that you have obtained appropriate consent for such processing.

9.3 Data Security: While we implement industry-standard security measures, no system is completely secure. You acknowledge the inherent risks of data transmission and storage.

10. Professional Responsibility

10.1 Licensing: You warrant that you are properly licensed to provide beauty services in your jurisdiction and will maintain all required licenses and certifications.

10.2 Client Safety: You are solely responsible for the safety and well-being of your clients. Our platform is a tool to assist your professional practice, not replace your expertise.

10.3 Compliance: You agree to comply with all applicable laws, regulations, and professional standards in your jurisdiction.

11. Communication Consent

By using our SMS and email features, you confirm that you have obtained proper consent from your clients to receive communications. You can manage consent preferences in client profiles. Clients can revoke consent at any time by replying STOP to text messages or updating their profile settings.

Standard messaging and data rates may apply for SMS communications.

12. Payment Terms

Subscription fees are billed in advance and are non-refundable except as required by law. AI tokens and premium features are subject to separate pricing and terms.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILQUECRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify and hold harmless SilqueCRM from any claims, losses, damages, liabilities, and expenses arising from your use of the service or violation of these terms.

15. Termination

We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the service ceases immediately.

16. Changes to Terms

We may update these terms from time to time. We will notify users of material changes and may require re-acceptance of updated terms. Continued use after notification constitutes acceptance of new terms.
